adventureafter30.com is a site operated by Adventure After 30 Ltd. We are registered in Northern Ireland under company number NI 738721 and have our registered office at 15 Wyncairn Gardens, Larne, Northern Ireland BT40 2EB. Adventure After 30 is not currently VAT registered.
These Booking Terms and Conditions are your contract with us for the provision of any Holiday Services you book with us. They apply together with our Privacy Policy and our Acceptable Use Policy.
1. Definitions
- “Holiday” — means any type of Adventure After 30 holiday constituted in the services we offer.
- “Holiday Services” — means our service in providing a Holiday.
- “Regulations” — means The Package Travel and Linked Travel Arrangements Regulations 2018.
- “Confirmation Invoice” — means our completed, dated Holiday confirmation invoice for your Holiday.
- “you”, “your” — means you, and includes the lead named person on the Confirmation Invoice (who must be at least 18 years old at the time of booking) and all persons on whose behalf you make a booking.
- “we”, “us”, “our” — means Adventure After 30 Ltd.
2. Contract between you and us
- Our Holiday Services vary. Whichever Holiday Services you choose, these Booking Terms and Conditions, together with our Confirmation Invoice, will constitute the contract between you and us, and will apply unless we indicate otherwise.
- The contract between you and us formally comes into existence when we send you our Confirmation Invoice. This will set out and confirm the specific details of your chosen Holiday Services. You will have undertaken to pay for your booking, and we will have undertaken to provide you with your chosen Holiday Services, in accordance with the relevant corresponding Holiday details on our website.
- If we are unable to accept your booking, we will of course return your payment to you immediately.
- When you make a booking with us, whether or not through our website, you have the benefit of our full compliance with the Regulations.
- For you to make a booking, we require your deposit and the booking details requested at checkout on our website. Our Confirmation Invoice will be sent to you by email.
We may decline your booking for any reason, and we do not have to give you the reason. If that happens, we will return your money to you as quickly as possible, and in any event within 14 days.
3. Your authority to book for other people
- If you make a booking on behalf of any other people as well as yourself, you guarantee that you have the authority of each of those other people to enter into the contract, and that you and they have agreed to be jointly and severally liable to us. You accept personal liability for the acceptance of, and compliance with, the contract by each of those people.
- It is your responsibility to ensure that all the details on your travel documents are correct and to notify us of any discrepancy or misunderstanding immediately. We will also look only to you for making payments as they become due, ensuring the accuracy of the personal details and other information supplied by other members of your party, and for whatever liaison is necessary to keep them fully informed.
- As lead member of your party, we will deal only with you in our correspondence.
4. What is included in the price
- Travel from the meeting point to your return to the departure point;
- Accommodation and most meals (unless otherwise stated in the Holiday itinerary);
- Drinking water;
- Services of one or more representatives or leaders;
- All activities in the itinerary (unless otherwise stated in the Holiday itinerary).
The full details for your Holiday will be itemised and/or referenced, as applicable, in your Confirmation Invoice.
5. What is not included
- Any flights to and/or from the holiday destinations, travel to the meeting point, and travel from the departure point;
- All other costs incurred before you board transport at the meeting point and after you return to the departure point;
- Travel insurance or any other insurance personal to you;
- Passport and visa costs;
- Vaccinations and medication, before, during and after the Holiday;
- Food and drink over and above what we include in the Holiday;
- Gratuities you choose to give, in addition to any we give on your behalf where we consider appropriate.
The full details for your Holiday will be itemised and/or referenced, as applicable, in your Confirmation Invoice.
6. Holiday prices
- When you make your booking, we’ll ask for a deposit to secure your place, usually £195 per person. A small number of destinations carry a higher deposit, where our on-the-ground partners require more upfront (for things like permits or accommodation that can’t be held any other way). Whatever the amount, we’ll always show it clearly before you book, so there are no surprises.
- Any booking made less than 13 weeks prior to the departure date must be accompanied by full payment at the time of making the booking.
- We reserve the right to increase the price of your booking after you have booked, but no later than 20 days before the start of your Holiday, only where there is a change in:
- the price of the carriage of passengers resulting from the cost of fuel or other power sources;
- the level of taxes or fees on the travel services included in your booking, arising from the imposition by third parties not directly involved in the performance of your package, including tourist taxes, landing taxes, or embarkation or disembarkation fees at ports and airports; or
- the exchange rates relevant to your package.
- (a) accept the change; or
- (b) cancel your booking and receive a full refund of all monies you have paid to us, except for any amendment charges already incurred.
Deposits are non-refundable, except as mentioned below; however, in some cases deposits may be transferable to another Adventure After 30 Holiday.
The balance of the price must be paid at least 90 days before your departure date. If the balance is not paid on time, we will cancel your travel arrangements and retain your deposit.
7. Special requests and special requirements
Any special requests and/or special requirements relating to your travel arrangements must be provided to us by email at the time of booking. While we will try to meet your reasonable special requests and/or special requirements, we do not guarantee that they will be fulfilled.
If we are able to confirm a special request and/or special requirement, we will do so by email at least 4 weeks before your departure date.
8. Sleeping arrangements
Unless a single supplement has been purchased and confirmed by us in writing, our Holidays are based on shared twin-room accommodation, with roommates matched based on the information you provide at the time of booking.
We want every traveller to feel safe and comfortable with their rooming arrangement. If you are transgender, non-binary, or have any other rooming preference or requirement, please tell us at the time of booking so we can discuss the best arrangement with you directly.
9. Minimum participants required for the Holiday
- As stated on our website, a minimum number of participants are required in order for the Holiday to go ahead. Therefore, we have a right to cancel any Holiday for which there are insufficient reservations and/or bookings.
- In the event of any such cancellation, all deposits or other related payments made specifically to Adventure After 30 will be refunded in full.
- We reserve the right to cancel any Holiday, for which there are insufficient reservations and/or bookings, not less than 13 weeks prior to the departure date. In the event of our cancellation, your deposit (and any other related payment you may have made to us) will be refunded in full, or, if you prefer, transferred to an alternative Adventure After 30 Holiday.
- You agree that all these provisions are reasonable.
10. Changing your booking
We will always do our best to help you with any change to your booking. However, we give no guarantee that we will succeed. If you require any change, you must tell us by email.
A change will be subject to an administration charge of £50 plus any reasonable costs we incur in making the change for you. Please note that the costs we incur are likely to be higher the closer you are to the departure date. Most travel arrangements cannot be changed once a reservation has been made.
11. Transferring your booking
If you would like to transfer your booking to another person, the following provisions apply:
- The transferee must satisfy any special conditions or qualifications applicable to the Holiday.
- You must inform us by email about your intention to transfer your booking to the transferee at least 14 days before the departure date.
- You and the transferee accept that you will be jointly and severally liable for full payment of any outstanding sums due in respect of the booking as well as fees, charges or other related costs arising from the transfer.
- Our administration charge for a transfer made more than 14 days before departure is £50. For a transfer made within 14 days before departure the administration charge is £200.
- We will not refund or compensate you if changes made to your booking, or re-booking, leave you paying for parts of the Holiday Services which you do not use.
12. Cancellation by you
If you or a member of your party needs to cancel your booking, you must tell us by email. We will not accept a cancellation by telephone alone. Cancellation incurs costs for us. Costs vary considerably and are not always precisely identifiable. We therefore charge a rounded cancellation fee as follows:
Standard cancellation charges
- 90 or more days before departure: loss of deposit. In some cases the deposit may be used as credit towards a future Adventure After 30 trip (valid for 12 months from the date of cancellation).
- 89–60 days before departure: 50% of the cost of the trip. Deposit may not be used as credit.
- 59 days or fewer before departure: 100% of the cost of the trip. Deposit may not be used as credit.
Please note — Uganda gorilla and chimp permits: for Holidays that include gorilla trekking or chimp tracking in Uganda, the cost of your permit is purchased on your behalf from the Uganda Wildlife Authority once payment is received, at the rate set by that authority. Permits are non-refundable and non-transferable from the point of purchase, regardless of when in the cancellation timeline this falls, and this cost sits outside the standard cancellation charges set out above.
- If you or a member of your party cancels your booking due to an uncontrollable event affecting the Holiday, then we will not charge the cancellation fee set out above. The other provisions of this section will apply as is.
- In any circumstances giving rise to cancellation, we will consider allowing you to transfer the money you have paid to some other Adventure After 30 Holiday you choose. However, whether we do so is at our discretion, and we do not have to give you a reason.
- If you or a member of your party wishes to cancel your booking due to unavoidable and extraordinary circumstances occurring at the place of destination or its immediate vicinity, and which significantly affect the performance of your Holiday or significantly affect the carriage of passengers to the destination, you may do so without paying the cancellation charges set out above. You will be entitled to a full refund of any monies you have paid, but will not be entitled to additional compensation.
13. If we cancel your Holiday or make changes
As we make travel arrangements far in advance, we sometimes need to change an arrangement, and occasionally we need to cancel a Holiday. If that happens, the following provisions apply:
- We will always inform you as soon as possible about any change. If that happens you may:
- accept the change; or
- accept our offer of alternative travel arrangements of a comparable standard; or
- cancel your booking, and we will give you a full refund of all money paid.
- We will not compensate you for minor changes outside our control. Examples of this are changes to your independently arranged and booked flight times, aircraft type or different carriers.
- Provided your final payment has been made, we will only cancel your travel arrangements in circumstances where we have no other option.
14. If you have a complaint
Your point of contact during your Holiday will be your Adventure After 30 tour leader, alongside our local partner’s representative; full contact details for both will be provided in your pre-departure information pack.
If you have any problems at all with your Holiday and/or during your Holiday, it is important that you immediately inform the relevant provider as well as our representative.
If you complain only after you have returned home, we will not be able to investigate the problem — for your benefit and ours. If that happens, you may lose your right to compensation.
If you feel our representative has not resolved your problem, please email us within 14 days of your return at hi@adventureafter30.com, providing full details of your Holiday, and concise details of the complaint and any subsequent history.
15. Your financial protection
We are a member of Protected Trust Services. Your payments are held in a secure and ring-fenced HSBC trust account that is managed by external trustees. You can verify our membership by contacting PTS directly.
16. Limitations on our liability
- We want you to enjoy a perfect holiday with Adventure After 30, and we will do our best to make this experience special for you. In accordance with The Package Travel and Linked Travel Arrangements Regulations 2018, we will be responsible for the proper performance of the travel services included in the contract between you and us, and we will provide assistance to you if you are in difficulty. However, we must make clear the limitations in law.
- If we fail to provide the Holiday set out on our website, and to which these Booking Terms and Conditions (together with our Confirmation Invoice) apply, we will pay you appropriate compensation. We are not liable if any failure is due to:
- your own carelessness or negligence in any aspect of your behaviour while on Holiday;
- medical emergencies;
- laws, culture and standards of service and behaviour in any country we may visit;
- changes we reasonably make to a Holiday itinerary, or to accommodation, or any other aspect of the management of your booking;
- third party circumstances unconnected with the provision of travel arrangements, which we could not reasonably have foreseen, prevented or avoided;
- any other unusual and unforeseeable circumstances beyond our control;
- a specific event, or series of events, which we or our providers could not reasonably have foreseen, prevented or avoided.
- We and you are subject to international conventions, when they apply. This may limit the amount of a claim you may make, against us or anyone else.
- The Holiday Services included in your booking are those specified on our website. If you choose to buy other goods or services during your Holiday, those goods or services do not form part of our Holiday Services, even if our representative helps you to buy or arrange them. Accordingly, we are not liable to you for any happening in connection with those other goods or services.
- It is a condition of the contract between you and us that you take out a travel insurance policy for every trip outside the UK. You alone are wholly responsible for arranging your insurance. The period of your travel insurance policy cover should start no later than the date you make your booking with us. We reserve the right, at any time, to require you to provide us with proof of your travel insurance policy.
- Further information on the type of travel insurance policy you are required to take out for the purposes of our contract is set out on our website. In addition:
- Adventure After 30 does not limit its liability for death or personal injury caused by our negligence; and
- in relation to any other loss or damage, Adventure After 30 limits its liability in respect of that loss or damage only to the extent (and in that case, to the fullest extent) permitted by law.
17. Passport, visa and immigration requirements
It is important that you obtain and carefully check the travel and immigration documents required for each country you visit. You alone are responsible for obtaining the required travel documents for your party.
We do not accept responsibility for any delay or problem which may occur in this respect.
If we have local representation at the time of any such problem, we will assist you as far as reasonably practical and possible. However, for the benefit of other travellers on that Holiday, it will not be possible to delay or change travel arrangements or events which will affect others in the Holiday group.
18. Help we need from you
Your information pack will provide details about your chosen Holiday; however, the following are contractual matters:
- Most Adventure After 30 Holidays require reasonable physical fitness and appropriate footwear. Each trip will lay out appropriately the required level of fitness needed. You should be prepared to walk up to a couple of miles a day, sometimes on uneven or slippery surfaces.
- To satisfy the majority of our clients, we apply strict no-smoking rules in the same way that they are applied by law in the UK. However, please note that smoking is permitted in some countries we may visit, so we cannot prevent third parties from smoking in a bar or restaurant.
- If, at our discretion, we advance funds on your behalf for medical treatment during the Holiday because you are unable to pay directly, we will provide receipts for those costs for your insurer, and you agree to repay us in full within 20 days of your return. We are under no obligation to advance such funds and may require confirmation of your insurance cover before doing so.
- If at any time it is our opinion (given by any of our staff or representatives) that you are acting in a way which may cause accident, injury, discomfort or extreme displeasure to any other travellers, we may exclude you from the Holiday itinerary programme for the remainder of the Holiday. This extreme action will not be taken lightly; however, it may be necessary to protect the health, safety or enjoyment of other travellers.
19. Terms and conditions of third party providers
Some of the services we provide are provided by third parties, and not directly by us. Each third party provider has their own terms and conditions.
While the law provides that we are liable to you generally for any failure connected with a third party provider, our obligations do not cover every contractual term.
Accordingly, instances may arise where you have no redress, for example in the purchase of locally produced goods. For example, if our representative warns you of a possible problem, for example related to food, and you choose not to take that advice, then we are not liable for any problem which may arise.
20. General
- We take your privacy seriously and we will only use your personal data in accordance with our Privacy Policy.
- If any provision of these Booking Terms and Conditions is at any time held by any jurisdiction to be void, invalid or unenforceable, then that provision shall be treated as changed or reduced, only to the extent minimally necessary to bring it within the laws of that jurisdiction, and to prevent it from being void. That provision shall then be binding in that changed or reduced form. Subject to that, each provision shall be interpreted as severable, and shall not in any way affect any other of these provisions.
- Any obligation in these Booking Terms and Conditions intended to continue to have effect after termination or completion shall so continue.
- No failure or delay by any party to exercise any right, power or remedy will operate as a waiver, or indicate any intention to reduce that or any other right in the future.
- In the event of a dispute between the parties to these Booking Terms and Conditions, each party shall undertake to attempt to settle the dispute by engaging in good faith with the other, in a process of mediation, before commencing arbitration or litigation.
- These Booking Terms and Conditions do not give any right to any third party under the Contracts (Rights of Third Parties) Act 1999 or otherwise, except that any provision in these Booking Terms and Conditions which excludes or restricts the liability of the directors, officers, employees, subcontractors, agents and affiliated companies of a party may be enforced under that Act.
- Any communication to be served on either of the parties by the other will be delivered by hand or sent by first class post or recorded delivery or by email. It will be deemed to have been delivered:
- if delivered by hand: on the day of delivery;
- if sent by post to the correct address: within 72 hours of posting;
- if sent by email to the address from which the receiving party has last sent email: within 24 hours, if the sender has received no notice of non-receipt.
- These Booking Terms and Conditions, their subject matter and their formation, are governed by Northern Irish law. You and we agree that the courts of Northern Ireland will have exclusive jurisdiction concerning all matters arising in connection with these Booking Terms and Conditions.
